Spousal Maintenance and Marital Contribution

Are you involved in a Colorado spousal maintenance case? An experienced Colorado Springs divorce and child custody lawyer can guide you through the legal process and assist you in exploring your options. You have one bite at the apple in the court system so make it count.

Parties can contribute in different ways to a marriage; economically and otherwise. Courts recognize both types of contributions. The classic example is a marriage where the arrangement between the parties was that one spouse would work outside of the home and earn an income, and the second would take care of the home and provide non-economic support to the household and the income-earning spouse. In such marriages, the income-earning spouse may feel that he or she was the person supporting the marriage because he or she generated the income. However, courts recognize that the ability to generate income is higher if that income-generator has household support that allows him or her to focus on employment and earning income.

There are also other ways that one spouse can contribute to the other in a marriage in a manner that is relevant to the dissolution. For example, sometimes one spouse will pay the other spouse’s separate debt, or enhance the other spouse’s separate real property. These types of contributions may be considered. A common example is one spouse obtaining an educational certificate or degree leading to improved potential for employment utilizing marital funds. If a marriage is dissolved shortly after completion of the academic program, then only one spouse may enjoy the benefits of the marital sacrifice, and possibly the costs of procuring the decree at marital expense should be allocated to the spouse who will benefit from the degree moving forward.
